1. INTRODUCTION

Welcome to FIZO. These Terms and Conditions ("Terms") govern your access to and use of the FIZO website (https://www.fizorun.com) and any related services (collectively, the "Services") where we sell our custom 3D-printed footwear and related products.
These Terms constitute a legally binding agreement between you (whether as a guest or registered user) and FIZO. By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use our Services.

2. ELIGIBILITY

Our Services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our Services are not available to minors (under the age of 18). If you are a minor, you may use our Services only with the involvement and permission of a parent or guardian.

3. ACCOUNTS

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. FIZO CUSTOMIZATION SERVICES

  • A. Personalized Manufacturing: FIZO's core products are customized based on the personal data you provide, such as 3D foot scans, weight, and specific foot dimensions (e.g., via Volumental technology) ("Customization Data"). You grant FIZO a non-exclusive, royalty-free license to use this Customization Data solely for the purpose of manufacturing and delivering your custom product.
  • B. Data Accuracy: You are solely responsible for ensuring the accuracy of the Customization Data you submit. FIZO is not liable for any ill-fitting or defective product resulting from inaccurate or incomplete data provided by you.
  • C. Final Sale for Custom Products: <Glider 001>Due to the personalized nature of our 3D-printed footwear, all sales of custom products are final and cannot be returned or refunded unless the product has a significant manufacturing or quality control defect.</font>

5. ORDERS

  • A. Order Acceptance: Your order constitutes an offer to purchase our products. All orders are subject to acceptance by us. A confirmation email does not signify our acceptance of your order; it only confirms we have received it. We reserve the right to refuse or cancel your order for any reason, including limitations on quantities, inaccuracies, or errors in product or pricing information.
  • B. Pricing: We may change our prices at any time without notice. However, price changes will not affect orders that we have already confirmed.

6. PAYMENT

All prices are shown in the stated currency (e.g., USD). Payment is processed securely through our third-party payment processors (e.g., Shopify Payments). You agree to comply with their terms and conditions. You represent and warrant that you have the legal right to use any payment method you provide.

7. SHIPPING & DELIVERY

We will arrange for the shipment of products via our logistics partners. While we provide estimated delivery times, these are not guarantees. <Glider 001>The risk of loss and title for such products pass to you upon our delivery of the product to the carrier.</font> For international orders, FIZO will cover any applicable customs duties and import taxes.

8. RETURNS, EXCHANGES & WARRANTY

  • A. Custom Product Policy: As stated in Section 4.C, <Glider 001>custom products are final sale.</font>
  • B. Exchanges for Standard Products: For non-custom, standard products, we offer exchanges or store credit within 30 days of delivery, provided the product is unworn, in its original packaging, and in resalable condition.
  • C. Warranty & Defects: Warranty claims are limited to significant material or workmanship defects present upon delivery. To file a claim, you must provide photo or video evidence of the defect. FIZO will, at its sole discretion, determine the appropriate remedy, which may include repair or replacement.

9. USER CONTENT

"If you submit reviews, photos, or other content ("User Content") to our Services, you grant FIZO a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such User Content for any purpose in any media. You are solely responsible for the User Content you submit and agree that it will not violate any third-party rights or be unlawful, abusive, or obscene.

10. INTELLECTUAL PROPERTY

All content on our Services, including designs, 3D models, text, images, graphics, logos, and software, is the property of FIZO or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, or create derivative works without our express written permission. The FIZO name and logo are our trademarks, and you may not use them without our prior written consent.

11. DISCLAIMER OF WARRANTIES

YOUR USE OF OUR SERVICES AND PRODUCTS IS AT YOUR SOLE RISK. OUR SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FIZO EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, FIZO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR OUR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT YOU PURCHASED.

13. INDEMNIFICATION

You agree to indemnify and hold harmless FIZO and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our Services or your violation of these Terms.

14. TERMINATION

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

15. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

16. CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time at our sole discretion. The updated Terms will be posted on our website with a new "Last Updated" date. Your continued use of our Services after any change constitutes your acceptance of the new Terms.

18. SPECIAL PROVISIONS FOR UK AND EU CONSUMERS


18.1 Precedence: For consumers residing in the UK or the European Union (EU), the provisions of this Section 18 shall prevail in the event of any conflict with other sections of these Terms.

18.2 Exclusion of Right of Withdrawal: You acknowledge that FIZO 3D-printed footwear are "made to the consumer’s specifications" and "clearly personalized" (pursuant to Article 16(c) of EU Directive 2011/83/EU and Regulation 28(1)(b) of the UK Consumer Contracts Regulations 2013). As these goods are individually produced based on your specific biomechanical data after an order is placed, the 14-day right of withdrawal does not apply. All sales are final unless the product has a significant manufacturing defect.

18.3 Two-Year Legal Guarantee: Statutory legal guarantees of two (2) years apply to significant material or workmanship defects existing at the time of delivery.

Remedies: You are entitled to a repair or replacement free of charge for such defects.

Exclusions: This guarantee strictly excludes normal wear and tear, damage from unintended use (e.g., intensive athletic use), accidental damage, or improper maintenance.

18.4 Transfer of Risk: Notwithstanding Section 7, the risk of loss or damage passes to consumers in the UK and EU only when you (or a third party indicated by you) have acquired physical possession of the products.

18.5 Jurisdiction: As a consumer in the UK or EU, you benefit from the mandatory protections of your local laws and may bring legal proceedings in the courts of your place of residence.
